A Will is a legal document that allows you to assign an individual to deal with your estate according to your wishes after you die. Your Will also states how you want your estate to be divided once you die and, if you have children, who you would like to be the guardians of those children. While most Wills are relatively simple and straightforward, Wills can also be used in estate planning when dealing with significant assets.
A Power of Attorney is a legal document in which you give authority to another person to manage some or all of your financial affairs while you are alive but unable to. This document deals only with financial affairs, and not personal affairs (such as end of life decisions).
The Government of Manitoba has provided a great guidebook titled “Enduring Power of Attorney: A Guidebook for Donors and Attorneys.” Click here to access the guidebook.
A Health Care Directive allows you to express your wishes about the amount and type of health care and treatment you want to receive should you become unable to speak or otherwise communicate this yourself. It also allows you to give another person the power to make medical decisions for you should you ever be unable to make them yourself.
A basic Will, Power of Attorney, and Healthcare Directive is appropriate where there are no blended families, no corporate assets or business considerations, no special trusts and no specific gifts being made. Your lawyer will advise you if this option is appropriate for you.
